ABC has taken legal action against the Federal Communications Commission (FCC) over concerns regarding its broadcast license renewal process. The network, along with its parent company Disney and eight local stations, filed a lawsuit alleging that the FCC’s demand for early license review poses a significant threat to its operations.
The FCC, under the leadership of chairman Brendan Carr, initiated the early review of ABC’s licenses citing diversity practices. This move came shortly after a controversial joke by ABC’s late-night host Jimmy Kimmel, known for his criticisms of President Trump, sparked backlash.
In response to what it perceives as targeted attacks on its freedom of speech, ABC asserted that the administration’s actions pose an existential threat to its operations. The network emphasized that seeking legal recourse was the only option to address the alleged retaliation for its First Amendment rights.
The lawsuit highlights ongoing tensions between ABC and the FCC, including disputes over the morning talk show “The View” and equal-time rules. ABC argues that the administration’s actions extend beyond its network and could set a dangerous precedent for media companies nationwide.
Anna Gomez, the sole Democrat on the FCC, praised ABC and Disney for challenging what she described as censorship and government intimidation. Meanwhile, FCC chairman Brendan Carr defended the agency’s actions, emphasizing broadcasters’ responsibility to operate in the public interest.
The FCC reiterated its stance that broadcasters, including Disney-owned entities, must fulfill their public interest obligations. The commission stated that it would continue to investigate claims of discrimination and uphold regulatory standards in the broadcasting industry.
